NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
1.CONTEST DESCRIPTION: The Original Returns Contest (“Contest”) begins on Thursday, October 29th 2020 at 12PM MT and ends on Monday, November 2nd at 11:59PM MT (the “Contest Period”).
The sponsor of this Contest is IllFonic, LLC (“Sponsor”).
By participating in the Contest , each Entrant unconditionally
accepts and agrees to comply with and abide by these Official Rules
and the decisions of Sponsor, which shall be final and binding in all
respects. Sponsor is responsible for the collection, submission or
processing of Entries and the overall administration of the
Contest. Entrants should look solely to Sponsor with any
questions, comments or problems related to the Contest. Sponsor
may be reached by email at press@illfonic.com during the Contest Period.
2.ELIGIBILITY:
Sponsor, and their respective parents,
subsidiaries, affiliates, distributors, retailers, sales
representatives, advertising and promotion agencies and each of their
respective officers, directors and employees (the “Contest
Entities”), are ineligible to enter the Contest or win a
prize. Household Members and Immediate Family Members of such
individuals are also not eligible to enter or win. “Household
Members” shall mean those people who share the same residence at
least three months a year. “Immediate Family Members” shall
mean parents, stepparents, legal guardians, children, stepchildren,
siblings, stepsiblings, or spouses. This Contest is subject to
all applicable federal, state and local laws and regulations and is
void where prohibited or restricted by law. Entrants that enter from outside of the United States certify that their engagement is legal in accordance with their local law and hold the Sponsor harmless for any issues with their engagement in the contest.
3.PRIZES:
One (1) winner will each receive a prize of one (1) Alpha Predator figure, one (1) IllFonic shirt, and one (1) key for Predator: Hunting Grounds Viking Predator DLC for PS4 or PC. (Approximate retail value or “ARV”: $75)
Three (3) winners will each receive a prize of one (1) key for Predator: Hunting Grounds Viking Predator DLC for PS4 or PC. (Approximate retail value or “ARV”: $5)
Total prize ARV: $90
Only one prize per person and per household will be awarded. Gift cards
and gift certificates are subject to the terms and conditions of the
issuer. Prizes cannot be transferred, redeemed for cash or
substituted by winner. Sponsor reserves the right in its sole and
absolute discretion to award a substitute prize of equal or greater
value if a prize described in these Official Rules is unavailable or
cannot be awarded, in whole or in part, for any reason. The ARV of
the prize represents Sponsor’s good faith determination. That
determination is final and binding and cannot be appealed. If the
actual value of the prize turns out to be less than the stated ARV,
the difference will not be awarded in cash. Sponsor makes no
representation or warranty concerning the appearance, safety or
performance of any prize awarded. Restrictions, conditions, and
limitations may apply. Sponsor will not replace any lost or stolen
prize items.
All federal, state and/or local taxes, fees,
and surcharges are the sole responsibility of the prizewinner.
Failure to comply with the Official Rules will result in forfeiture
of the prize.
4.HOW TO ENTER:
How to Enter: During the contest period, users may submit an image they own as a post in the contest thread located at forum.predator.illfonic.com. By posting, users certify that they own all rights and have all permissions to share the posted image. Sponsor reserves the right to not review any particular image from being judged at Sponsor’s sole discretion.
All entry information and Photos shall be collectively referred to herein as the “Submissions” or each as a “Submission.” Submissions must comply with the Guidelines and Restrictions defined below.
By entering, each entrant warrants and represents the following with respect to entrant’s Submission: (a) entrant is the sole and exclusive owner of the Submission; (b) the Submission will not infringe on any rights of any third parties; and © any third parties appearing in the Submission have given entrant appropriate consent to be photographed and used a permitted herein. Sponsor reserves the right to request releases from any third parties appearing in any Submissions at any time. Failure to produce any rights releases upon Sponsor’s request may result in disqualification, as determined by Sponsor is its sole and absolute discretion.
Providing a Submission constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, nonexclusive license to use, reproduce, modify, publish, create derivative works from, and display such Submissions in whole or in part, on a worldwide basis, in perpetuity, and to incorporate it into other works, in any form, media, or technology now known or later developed, for any purpose whatsoever, including for any promotional or marketing purposes. For clarity, by providing a Submission, entrant also consents to give Sponsor a license to use entrant’s name, image, and likeness as included in the Submission on the same foregoing terms.
An entrant may submit one Submission during the Contest Period (defined below). If a user submits more than one image, then the one Submission shared will be judged at Sponsor’s discretion. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified.
All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, postage-due, misdirected, technically corrupted, or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human, or electronic. Proof of submission will not be deemed to be proof of receipt by Sponsor. By entering the Contest, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Contest.
All images must be original, meaning you may only enter photographs that you took and for which you own the copyright.
Content Restrictions:
The Submission must not contain materials which contain visible identifiable or potentially identifiable information, including but not limited to, phone numbers, website links, street addresses, email addresses or license plate numbers;
The Submission must not disparage Sponsor or any other person or party;
The Submission must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous;
The Submission must not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations of the United States or of any jurisdiction where Submission is created;
The Submission must be consistent with the image and values of Sponsor and be consistent with and satisfy the purpose of the Contest.
Sponsor reserves the right to delete or blur any inappropriate content from a submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Official Rules.
Each entrant acknowledges that other entrants may have used ideas and/or concepts in their Submission that may be similar in idea or concept to what is included in entrant’s Submission. Each entrant understands and agrees that he/she shall not have any claim against any other entrant or Sponsor arising out any such similarity or be entitled to any compensation because of any such similarity.
5.WINNER SELECTION:
Following the conclusion of the Contest Period, the Sponsor will commence the Judging Period of the Contest. During the Judging Period, each entry will be reviewed by a judge or panel of judges appointed by the Sponsor. Each entry will be judged based on the clear relationship between the submission and the following criteria:
Originality (25%)
Predator Universe Tie-in (25%)
Execution (25%)
Overall Impression (25%)
Judges will evaluate all valid entries and pick one First Place winner and three Runners Up. No entry scores will be shared or made available during or after the contest.
6.WINNER NOTIFICATION:
Winners will be notified by email associated with the Forum account or by Private Message by forum administration team approximately 1 business day after
selection. Potential Winner must accept a prize by email as
directed by Sponsor within one (1) days of notification. Sponsor is not
responsible for any delay or failure to receive notification for any
reason, including inactive email account(s), technical difficulties
associated therewith, or Winner’s failure to adequately monitor any
email account.
Any winner notification not responded to or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a
Publicity Release (collectively “the Prize Claim Documents”).
No substitution or transfer of a prize is permitted except by
Sponsor.
7.PRIVACY:
Any personal information supplied by you will be subject to the privacy policy of the Sponsor posted at https://www.illfonic.com/privacy-policy/. By entering the Contest, you grant Sponsor permission to share your email address and any other personally identifiable information with the other Contest Entities for the purpose of administration and prize fulfillment, including use in a publicly available Winners list.
First person to send a Private Message to Courier on the IllFonic forums with a message titled “GIMMIE THE GOOD STUFF” will receive a Predator Viking DLC code for PS4 or PC. Only one person can receive this code, and granting of this code will be from an independent prize pool but is bound by any necessary terms and conditions from this document. The person to receive this code will be announced in the cover post for this contest.
8.LIMITATION OF LIABILITY:
Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data
transmissions; (b) any unauthorized access to, or theft, destruction
or alteration of entries at any point in the operation of this
Contest; © any technical malfunction, failure, error, omission,
interruption, deletion, defect, delay in operation or communications
line failure, regardless of cause, with regard to any equipment,
systems, networks, lines, satellites, servers, camera, computers or
providers utilized in any aspect of the operation of the Contest;
(d) inaccessibility or unavailability of any network or wireless
service, the Internet or website or any combination thereof; (e)
suspended or discontinued Internet, wireless or landline phone
service; or (f) any injury or damage to participant’s or to any other
person’s computer or mobile device which may be related to or
resulting from any attempt to participate in the Contest or
download of any materials in the Contest.
If, for any reason, the Contest is not capable of running as planned
for reasons which may include without limitation, infection by
computer virus, tampering, unauthorized intervention, fraud,
technical failures, or any other causes which may corrupt or affect
the administration, security, fairness, integrity or proper conduct
of this Contest, the Sponsor reserves the right at its sole
discretion to cancel, terminate, modify or suspend the Contest in
whole or in part. In such event, Sponsor shall immediately suspend
all drawings and prize awards, and Sponsor reserves the right to
award any remaining prizes (up to the total ARV as set forth in these
Official Rules) in a manner deemed fair and equitable by Sponsor.
Sponsor and Released Parties shall not have any further liability to
any participant in connection with the Contest.
9. WINNER LIST/OFFICIAL RULES:
To obtain a copy of the Winner List or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to IllFonic, LLC. Requests for the names of the winners must be received no later than 60 days after the Contest Period has ended. For accessing a Winner List online, visit Twitter.com/IllFonic. The winner list will be posted after winner confirmation is complete.
