He’s innocent until proven guilty. He refused the breathalyzer so that means they had to take him in and get a warrant to draw his blood. All this takes time. By this time his blood alcohol content will probably be 0.
They either will just drop it or get him on obstruction of highway. So no, he doesn’t have a DUI and no reason to cancel him.
His charge is suspicion of DUI
They did take his blood after his arrest at the police station, he refused so it took a little longer than normal to take his blood because they had to put him in a restraint chair. His BAC would have therefore been lower than if he had taken a breathalyzer.
They found him asleep in a car that only had 3 wheels, turned off, parked at the side of the road, with the driver’s side door open. They had found the car by following tracks on the road from where someone had hit a curb. He’s rich and famous enough that I bet the suspicion of DUI charge doesn’t stick and he just has to do community service instead, he’ll probably just have to do a few commercials about the dangers of drinking and driving.
I can assure you his BAC will be zero. I was in a similar situation 5 years back and they had no choice but to drop the charge. Shit would’ve ruined me too.
