IllFonic didn’t get sued over the F13 game. The ongoing lawsuit is a dispute for the rights of the franchise by Sean Cunningham and Victor Miller.
They did pick a good time to walk away though. Gun hired another team to come in and try and fix glitches and bugs made by IllFonic’s coding and every time they fix something, seems like 5 more things break.
