Wow, and he hasn’t been shot?
Standing ovation?
That’s one of his life goals. Yous do have things in common.
I mean the decision to shoot comes down to scaling the threat to the public and officers safety.
It’d be pretty hard to brain someone with a 20 dollar plastic saber from Walmart, so progression would go (assuming suspect is uncooperative) negotiation to approach to tasers (or other non-lethal like dogs, rubber bullets, etc) that would fail then likely after that just having an officer tackle him.
The decision to shoot would be made if there was a threat to the public or the safety of the officers. So given that a would be Jedi is not able to harm others or the officers, use of lethal force would not be required.
Source: Have a close family friend who is law enforcement in our township.
The was a potential for him to use the force. Seems like a really high threat level. Rey destroyed a spaceship with that.
So taser comes before tackling?
Most often yes, as if the officer tackles a suspect there is a higher risk of injury to both parties (broken bones, environmental hazards, etc) but the suspect could also fight back when tackled.
The taser is the safest for both parties and as such is preferred to physical restraint if the suspect is hostile.
And I will preface that this is from one department of law enforcement in once specific area that is generally low crime. Other departments in different areas with different budgets may have slightly different methods of dealing with such scenarios.
Sounds logical.
Was the man intending to hit cops or was he messing around. Is it still an assault situation if no strike lands?
Don’t know. If he hit the officers he could be charged with assault of a law enforcement officer, if not and he was just messing around and didn’t hit them with it but swung it at them it could be attempted assault.
Probably a grey area, but would it matter if he actually tried to hit them or was only being an annoyance. It may be hard to tell. I guess an officer is not going to take a chance and see what happens.
Does verbal assault on police officer have any consequences? (If a person doesn’t have a visible weapon other than appanages). What if a person keeps bother a police officer with 'im gonna kick your ass’s or something similar? Would it be a more severe provocation if a person has a light saber and says ‘im gonna shove this light saber here up you ass’?
Correct, officers are not going to take a chance. Yeah, I’d say intention does matter. If he’s just tauntingly swinging it and trying not to hit them, then they’ll let him off easier than if he is full on trying to bludgeon them.
Yes. Most times if its minor stuff and its the first time police are willing to consider just giving a warning, be it verbal or written. Kindness does count. You don’t know if they just responded to a terrible call like a homicide or something worse, so I always treat officers with respect and kindness, as they are people too and should be treated as such.
Now if someone starts talking shit then the chances of getting a warning are drastically lowered. But if you’re fully cooperative, understanding, and just a decent human being then you have a decent chance of getting a warning.
That would be threatening an officer, and there could be consequences for that. Ultimately if it’s just words it’s the officer’s discretion.
Would that still work in general if some person was threatening another an officer was nearby and overheard the threat? Is the officer obliged to act on it?
Yes. The best way to stop a fight is prevention. The officer would be obliged to step in and prevent the exchange from escalating into violence.
Thanks for the answers. I guess there is no way to mess around with an officer as anything can be perceived as a threat. Its a no win situation.
Assault is the threat of a physical attack. Battery is the actual hitting. The more you know.
Also wrong. Supreme Court already ruled years ago that the cops have no requirement to defend or protect you. They could let you get shot and then arrest the shooter after for breaking the law.
Yeah. Best to air on the side of caution unless you personally know the officer really well, and even then it’s iffy unless the officer starts joking around.
Example would be when my mom got into a car crash (thankfully everyone was fine and it was the other guy’s fault for running a red light) and said close family friend who is high up in the chain of command of our township’s law enforcement was the responding officer. First thing he said to the rookie he was training when taking our statement was, “Arrest this woman and her son (me lol)! They are both crazy!!!” Cue a good minute of laughter from everyone except the rookie who was just confused.
How long did the keep you in custody?
Yeah but I already said this is practice from my township’s law enforcement, not what the absolute law is. If they see a fight before it happens, they’ll shut it down.
My point was don’t count on the police to save you. Smaller towns tend to have a lot better and friendlier cops who actually give a fuck.
10 minutes as the other guy was a kid who just got his license who already had a charge for the exact same thing. They ran our plates, checked ID, registration, & insurance, everything checked out and they let us on our way while ticketing and chewing the kid out.
Oh yeah. All our cops are really friendly and down to earth people. Like on 4th of July, big fireworks used to be illegal until this year, but they wouldn’t give a fuck as long as you didn’t burn someone’s house down. Hell said family friend would come over and help us light fireworks some years when he was in town.
Oh for sure. Especially in those larger cities and such.
I always make sure that I can save myself and my loved ones first.
Ya know what they say:
The average response time for police is 8 minutes, but the average response time to defend myself is 830 feet per second.
